Strategic Litigation Planning

The goal of Strategic Litigation is to create change through strategic panning and execution of individual cases in order to have an impact that stretches beyond the current case and client. While not every case litigated results in an immediate positive outcome for the client, the broader implications of implementing a successful strategic litigation plan could provide great benefit down the road in the way of changing the way laws are interpreted and applied to future cases.

In 1998, he helped keep the AG’s offices of nearly 46 states off my clients’ back in a uniquely tailored position created to assist with compliance while the company grew their small tobacco business in the face of a $208B master settlement agreement which paid those 46 states to maintain Big Tobacco’s market share by pursuing claims against smaller, new tobacco companies and which was being litigated in several federal courts. In 2008, Ziad sued the big banks holding his client‘s mortgages and the client got to keep his house after being almost 8 years in arrears. Ziad focused on the banks’ biggest weakness: being too big. That required knowing what was happening on the street and seeing the opponents’ weakness from a perspective they were too big or arrogant to see. They would take forever to respond to requests by debtors, so Ziad used that advantage to obtain a series of nearly fatal default judgements against the banks.

In 2018, Ziad chased a Big Pharmacy chain into bankruptcy to pursue my now deceased client’s malpractice claims that left her crippled as a result of their negligence.
